You could trade crypto on licensed Digital Asset Exchanges, but you could not access exchange-traded futures or options with exchange clearing guarantees. The Cabinet&#8217;s approval changes that. Under the amended Derivatives Act, crypto can underpin futures, options, and other derivative products on TFEX, which is supervised by the SEC and operates with Thailand Clearing House (TCH) as the central counterparty.<\/p>\n<p>The key legal implication: TFEX-traded crypto derivatives come with central counterparty clearing, meaning if your counterparty defaults, TCH absorbs the loss \u2014 not you. This is a meaningful protection that offshore crypto derivatives platforms do not provide.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Who_Can_Trade_and_Under_What_Rules\"><\/span>Who Can Trade and Under What Rules<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Under the proposed framework, eligible participants are retail investors with TFEX accounts who pass the required knowledge tests and suitability assessments. The same rules that govern equity index futures on TFEX will apply: position limits, daily price limits, and margin requirements set by TFEX and TCH. This means your TFEX position does not give you any rights to underlying crypto assets. Tax treatment of gains from crypto derivatives is also distinct from spot crypto gains \u2014 the Revenue Department&#8217;s treatment of futures profits differs from its treatment of digital asset disposals, and the 2026\u20132029 crypto tax exemption that applies to spot trading may not cover TFEX-traded derivatives. The legal protections are real.
