Examples: Bitkub, Bitazza, Upbit Thailand.<\/li>\n<li><strong>Digital Asset Brokers:<\/strong> Entities that execute trades on behalf of clients against multiple exchanges.<\/li>\n<li><strong>Digital Asset Dealers:<\/strong> Entities that trade digital assets as principal, acting as the counterparty to client trades.<\/li>\n<\/ul>\n<p>All three require SEC approval. Operating without a license carries criminal penalties of up to 5 years imprisonment and\/or a fine of up to 500,000 THB.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Which_Exchanges_Are_Currently_Licensed\"><\/span>Which Exchanges Are Currently Licensed<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>As of early 2026, SEC-licensed digital asset exchanges in Thailand include Bitkub, Bitazza, Upbit (Thailand), and a small number of others. Binance, OKX, Bybit, and other major international exchanges are <em>not<\/em> SEC-licensed in Thailand. Thai users can legally use these platforms \u2014 there is no law prohibiting Thai individuals from accessing foreign exchanges \u2014 but the exchanges themselves lack Thai regulatory coverage.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"What_Exchanges_Must_Do_Under_Thai_Regulation\"><\/span>What Exchanges Must Do Under Thai Regulation<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>SEC-licensed exchanges in Thailand must:<\/p>\n<ul>\n<li>Segregate client funds from company funds<\/li>\n<li>Maintain capital adequacy ratios<\/li>\n<li>Conduct proper KYC\/AML on all clients<\/li>\n<li>Report suspicious transactions to the Anti-Money Laundering Office (AMLO)<\/li>\n<li>Submit regular financial reports to the SEC<\/li>\n<li>Have Thai-language customer service capabilities<\/li>\n<\/ul>\n<h2><span class=\"ez-toc-section\" id=\"Token_Offerings_and_ICOs\"><\/span>Token Offerings and ICOs<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Initial Coin Offerings (ICOs) in Thailand require SEC approval through an SEC-licensed ICO portal. As of 2026, only a handful of ICO portals are approved. Any project raising money from Thai investors through token sales without going through this process is operating illegally.<\/p>\n<p>Thai investors should verify that any ICO they consider participating in has SEC approval \u2014 the SEC website maintains a public list of approved portals and offerings.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Tax_Obligations_for_Crypto_Investors\"><\/span>Tax Obligations for Crypto Investors<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Under the Revenue Department&#8217;s interpretation, crypto profits are treated as &#8220;assessable income&#8221; subject to personal income tax. The applicable rate depends on your total annual income and ranges from 0% (under 150,000 THB) to 35% (over 5 million THB).<\/p>\n<p>Losses can offset gains within the same tax year. There is currently no specific crypto capital gains tax rate \u2014 regular income tax rates apply.
